CAMELLIA NETWORK PRIVACY POLICY

Camellia Network (“we”, “our” or “us”, as applicable) in the United States is concerned about privacy issues and wants you to be familiar with how we collect, use and disclose information.  This Privacy Policy describes our practices in connection with information that we collect through http://camellianetwork.org (the “Site”).  By providing Personal Information to us, you agree to the terms and conditions of this Privacy Policy.

Through the Site, you can be a part of a caring community interested in supporting young adults who are emerging from the foster care system.  Young adults who meet certain criteria, set forth generally in our Terms of Service at https://camellianetwork.org/terms-service, are eligible to complete an application for acceptance into the Camellia Network (“Featured Youth Applicants”) as a Featured Youth.  Visitors to our Site who are not Featured Youth Applicants (“Supporter Non-Applicants”) may access certain content on our Site, register to receive e-newsletters, make donations through the Site and complete an application to create a Supporter profile (if a Supporter Non-Applicant creates a Supporter profile, such individual is a “Supporter Applicant”). Other organizations approved by us may use our Site by completing online registration forms to create profiles and to provide access to transition resources (“Transition Resource Partner Applicants”) or opportunities and other offers (“Opportunity Partner Applicants”) to the Featured Youth Applicants. This Privacy Policy describes how we collect, use and disclose information about Featured Youth Applicants, Supporter Non-Applicants, Supporter Applicants, Transition Resource Partner Applicants and Opportunity Partner Applicants.  All Applicants who are approved to join the Camellia Network are referred to as “Members,” and all of the above individuals, whether Members or not, are referred to as “Users.”  

UPDATES TO THIS PRIVACY POLICY

We may change this Privacy Policy from time to time.  Please take a look at the “LAST UPDATED” legend at the top of this page to see when this Privacy Policy was last revised. Any changes to this Privacy Policy will become effective when we post the revised Privacy Policy on the Site.  Your use of the Site following these changes means that you accept the revised Privacy Policy.  

INFORMATION WE COLLECT

Information Provided by You

Personal Information” is information that personally identifies you as an individual or other information that can be reasonably linked to such information, such as:

  • Name
  • Postal address
  • Telephone number
  • Email address
  • Credit or debit card number
     

We collect different types of Personal Information depending whether you are a Featured Youth Applicant, Supporter Non-Applicant, Supporter Applicant, Transition Resource Partner Applicant, Opportunity Partner Applicant, or Member.

Information You Provide in Creating and Using a Profile

If you are a Featured Youth Applicant, we will ask you to complete an application that requests Personal Information including your name, home and mailing addresses, email address, telephone number(s), age, date of birth, photograph of yourself, your history in the foster care system, verification relating to such history, and other required and optional demographic information (including education, employment status, family situation, primary language, gender, race, ethnicity, sexual orientation and religious affiliation).  We will also ask you to answer certain questions about yourself, your interests, and your opinions on issues related to our services as part of your application.  We may decide to change our application at any time to ask for additional information or modify the information we request.  During registration, we also will require you to create a username and password.

If you are a Supporter Applicant, we will ask you to complete an application that requests Personal Information including your name, home and mailing address, email address, telephone number(s), age, date of birth, photograph of yourself, and certain other information about your demographics and interests.  We may decide to change our application at any time to ask for additional information or modify the information we request.  During registration, we also require you to create a username and password.

If you are a Transition Resource Partner Applicant or Opportunity Partner Applicant, we will ask you to complete an application that requests Personal Information including the name and contact information for a person in your organization along with other information about your organization.  We may decide to change our application at any time to ask for additional information or modify the information we request.  During registration, we also require you to create a username and password.

Additionally, Members will have the opportunity to provide personal information in the public forums on the Site (such as their own profile pages or on profile pages of other Users).  We encourage Users to never provide sensitive personal information in such manner.  We may nonetheless collect all such information that is posted.

Information You Provide when Completing Donation Transactions

If you are a Supporter Non-Applicant or Supporter Applicant, we may collect the Personal Information including name, postal address, telephone number, and email address, and information about donations you make. While we generally do not collect credit card information, anyone making a donation on our Site may have that information by our third-party service provider (see below under “Third Party Sites” for more information).  We collect information regarding donation transactions individually and in the aggregate.

Other Information We Track

Additionally, we collect information about all Users of our site:

  • Browser information
  • Server log files
  • Information collected through cookies, pixel tags and other technologies
  • Aggregated information

How We Collect the Information

We collect information that you give us voluntarily when you apply for and complete profiles, make donations or complete other transactions, request to be added to a mailing list or otherwise give us your information while using the Site.
We and our third party service providers may collect information in a variety of ways relating to your use of our Site, including:  

  • Through your browser:  Certain information is collected by most browsers, such as your Media Access Control (MAC) address, computer type (Windows or Macintosh), screen resolution, operating system version and Internet browser type and version.
  • Through server log files:  An Internet Protocol (IP) address is a number that is automatically assigned to the computer that you are using by your Internet Service Provider (ISP), and is identified and logged automatically in our server log files whenever a User visits the Site, along with the time of the visit and the page(s) that were visited.  We use IP addresses for purposes such as calculating Site usage levels, helping diagnose server problems, and administering the Site.  
  • Using cookies:  Cookies allow a web server to transfer data to a computer for recordkeeping and other purposes.  We and our service providers use cookies and other technologies to, among other things, better serve you with more tailored information and facilitate your ongoing access to and use of the Site, as well as for online tracking purposes.  If you do not want information collected through the use of cookies, there is a simple procedure in most browsers that allows you to decline the use of cookies.  To learn more about cookies, please visit http://www.allaboutcookies.org/.  If you choose to decline cookies, some or all of the features, functionality and promotions available through the Site may not be available to you.  
  • Using pixel tags and other similar technologies:  Pixel tags (also known as web beacons and clear GIFs) may be used in connection with some Site pages and HTML-formatted email messages to, among other things, track the actions of Site Users and email recipients, measure the success of our marketing campaigns and compile statistics about Site usage and response rates.  
  • By aggregating information:  We may aggregate Personal Information so that the end-product does not personally identify you or any other User of the Site, for example, by using Personal Information to calculate the percentage of our Users who have a particular telephone area code.  Aggregated Personal Information does not personally identify you or any other User of the Site.

HOW WE USE THE INFORMATION WE COLLECT

How We Use Personal Information

We do not sell, trade, or rent your personal information. However, we may use Personal Information:

  • To respond to your inquiries and fulfill your requests.
  • To communicate with you about our program, youth updates and progress that we believe may be of interest to you.
  • To send you important information regarding the Site, changes to our terms, conditions, and policies and/or other administrative information.  
  • To complete and fulfill your transaction, for example, to process your payments or donations, have your order delivered to you, communicate with you regarding your transaction and provide you with related customer service.
  • To our affiliates, such as Transition Resource Partners, to permit them to send you communications relating to our mission or that we otherwise believe to be of interest to you.
  • To third parties to permit them to send you communications relating to our mission, that we believe to be of interest to you, or that we otherwise deem appropriate in conformance with the limitations of this Privacy Policy and our Terms of Service.
  • To personalize your experience on the Site by presenting information and opportunities tailored to you and to allow for interaction between Users of the Site within the scope of our Terms of Service.
  • To allow you to participate in contests and similar promotions and to administer these activities.  Some of these activities have additional rules, which could contain additional information about how we use and disclose your Personal Information, so we suggest that read these rules carefully – in the event of a conflict between those rules and this Privacy Policy, those rules will govern.
  • For our business purposes, such as data analysis, audits, enhancing our website, improving our services, identifying usage trends and determining the effectiveness of our promotional campaigns.  
  • To send newsletters and make other communications for the purpose of furthering the mission of Camellia Network in any way, provided that we shall not disclose full names or addresses in such materials.
  • As we believe to be necessary or appropriate: (a) under applicable law, including laws outside your country of residence; (b) to comply with legal process; (c) to respond to requests from public and government authorities including public and government authorities outside your country of residence; (d) to enforce our terms and conditions; (e) to protect our operations or those of any of our affiliates; (f) to protect our rights, privacy, safety or property, and/or that of our affiliates, you or others; and (g) to allow us to pursue available remedies or limit the damages that we may sustain.

Additionally, if you are a Featured Youth Applicant, we may use Personal Information:

  • To verify statements made in your application for membership in the Camellia Network.
  • To send you important information about your membership in (or membership application for) the Camellia Network.
  • To monitor your compliance with the terms and conditions of membership in the Camellia Network.


We may also use your Personal Information in any other way not set forth above after receiving your consent to such use.

How Information is Disclosed

Your Personal Information may be disclosed:

  • To our third party service providers who provide services such as website hosting, data analysis, payment processing, order fulfillment, infrastructure provision, IT services, customer service, email delivery services, credit card processing, auditing services and other similar services to enable them to provide services.
  • To third-party sponsors of contests and similar promotions.
  • To a direct or indirect subsidiary or other entity under common control with us that is organized to carry out our mission or a related mission.
  • To a third party in the event of any reorganization, merger, sale, joint venture, assignment, transfer or other disposition of all or any portion of our business, assets or stock (including in connection with any bankruptcy or similar proceedings).
  • As we believe to be necessary or appropriate: (a) under applicable law, including laws outside your country of residence; (b) to comply with legal process; (c) to respond to requests from public and government authorities including public and government authorities outside your country of residence; (d) to enforce our terms and conditions; (e) to protect our operations or those of any of our affiliates; (f) to protect our rights, privacy, safety or property, and/or that of our affiliates, you or others; and (g) to allow us to pursue available remedies or limit the damages that we may sustain.

If you are a Featured Youth Applicant who is accepted into the Camellia Network, we may allow you to create an online profile on the Site that includes your first name and first initial of your last name, age, state of residence, photograph, time in foster care, and number of foster care placements.  We also may post personal profile information (such as your strengths and fears, your goals, and your progress) and your registry requests.  If you are accepted as a Member in the Camellia Network, you may not choose which information you would like to post to your profile; as a condition of membership in the Camellia Network, you must provide a response to each category of information which we request from you. Please note that your profile information will become public information, and may be available to visitors to the Site and to the general public.  We urge you to exercise caution in deciding to disclose any Personal Information in your profile and reserve the right to remove any information we deem too personal. As detailed in the Terms of Service, we may refuse to display, modify before displaying, or juxtapose the display of the information you provide in our sole discretion.  PLEASE NOTE THAT WE ARE NOT RESPONSIBLE FOR THE USE BY OTHERS OF ANY PERSONAL INFORMATION YOU DISCLOSE IN YOUR PROFILE OR ON THE SITE.

If you are a Supporter Applicant, Transition Resource Partner Applicant or Opportunity Partner Applicant who is accepted as a Member in the Camellia Network, we may allow you to create an online profile on the Site that includes your first name and first initial of your last name (or entity name), age (if applicable), state of residence or primary place of business, employment, and photographs.  We also may post personal profile information (such as your strengths, fears, and goals) that you provide when completing your profile and the donations you have made.  If you are accepted as a Member in the Camellia Network, you may not choose which information you would like to post to your profile; as a condition of membership in the Camellia Network, you must provide a response to each category of information which we request from you. Please note that your profile information will become public information, and may be available to visitors to the Site and to the general public.  We urge you to exercise caution in deciding to disclose any Personal Information in your profile and reserve the right to remove any information we deem too personal.  As detailed in the Terms of Service, we may refuse to display, modify before displaying, or juxtapose the display of the information you provide in our sole discretion.  PLEASE NOTE THAT WE ARE NOT RESPONSIBLE FOR THE USE BY OTHERS OF ANY PERSONAL INFORMATION DISCLOSE IN YOUR PROFILE OR ON THE SITE.

We will not share any sensitive personal information (race or ethnicity, religious beliefs or sexual orientation) without obtaining your opt-in consent.

How to Limit Public Sharing on the Site

If you decide that you no longer want to be a Member in the Camellia Network, you may contact us at info@camellianetwork.org to request the removal of your name and profile from our Site.  Personal Information and other data that you furnished through the Site may remain in our records, even if you are no longer a Member, and can be used by us in accordance with this Privacy Policy.  

How We Use and Disclose Non-Personal Information

Because Non-Personal Information does not personally identify you, we may use and disclose Non-Personal Information for any purpose.  In some instances, we may combine Non-Personal Information with Personal Information (such as combining your name with your zip code).  If we combine any Non-Personal Information with Personal Information, the combined information will be treated by us as Personal Information as long as it is combined.

CHOICES AND ACCESS

If you would like to review or update your Personal Information, you may contact us at info@camellianetwork.org.  Additionally, a Member may edit his or her profile by logging in using his or her username and password.

THIRD PARTY SITES

This Privacy Policy does not address, and we are not responsible for, the privacy, information or other practices of any third parties, including, without limitation Facebook, Twitter or any other third party operating any site to which this Site contains a plugin or link.  The inclusion of a plugin or link on the Site does not imply endorsement of the linked site by us or by our affiliates.  
We use a third-party service provider, Braintree Payment Solutions LLC (the “Payment Service") to handle and process the donations made by credit card and other payment transactions submitted through the Site. We have no control over, and shall not be responsible for, the Payment Service’s use of your Personal Information. PLEASE NOTE THAT THIS POLICY DOES NOT ADDRESS THE COLLECTION AND USE OF INFORMATION THROUGH THE PAYMENT SERVICE OR THE PRIVACY OR INFORMATION PRACTICES OF THE PAYMENT SERVICE.

THIRD PARTY ADVERTISERS  

We may use third-party advertising companies to serve ads when you visit our Site.  Please note that these companies may use information about your visit to this Site in order to provide advertisements about goods and services that may be of interest to you.  In the course of serving advertisements to this Site, these companies may place or recognize a unique cookie on your browser.  If you would like more information about this practice and to know your choices about not having this information used by these companies, please visit http://networkadvertising.org/optout_nonppii.asp.

SECURITY

We use organizational, technical and administrative measures to protect Personal Information under our control.  Unfortunately, no data transmission over the Internet or data storage system can be guaranteed to be 100% secure.  If you have reason to believe that your interaction with us is no longer secure (for example, if you feel that the security of any account you might have with us has been compromised), please immediately notify us of the problem by contacting us in accordance with the “Contacting Us” section below.

USE OF SITE BY MINORS

The Site is not directed to individuals under the age of thirteen (13), and we request that such individuals not use or provide Personal Information through the Site.  Individuals between the ages of thirteen (13) and eighteen (18) may use the Site if their parents or legal guardians have consented to the Terms of Service and Privacy Policy on their behalf.
 

JURISDICTIONAL ISSUES

The Site is controlled and operated by us from Sacramento California, and is not intended to subject us or any affiliated entity to the laws or jurisdiction of any other state, country or territory other than those of California and the United States.  We may limit the Site’s availability, in whole or in part, to any person, geographic area or jurisdiction we choose, at any time in our sole discretion.
